When you start an online business, there are a ton of things you need to check.
One of them is to obtain licenses and permits needed to sell your products.

01Creating an ecommerce website and app

When you open an online store in Vietnam, the first thing you need to do is to choose a business line in which you will operate,
such as import-export, wholesale, and retail, and create an enterprise.
If you are a retailer, you need to get a business license (BL) after building your enterprise in Vietnam.
In general, it takes three to four months to acquire a business license.
You should also go through a registration or notification process to run your business on the website or mobile app.
It is also required to display a registration or notification badge on your website or mobile app.

1) Ecommerce website
Registration process for website
  1. Create an account at "online.gov.vn."
    * You can proceed with further steps after receiving the signup confirmation email from the Ministry of Industry and Trade (MoIT).
  2. Enter name of the business, tax code, address, website name, website address, and other required details in the website registration form.
  3. Select a product or service to sell.
  4. Select your ecommerce business type: online marketplace, online classified, or online auction
  5. Select related services, such as online payment and online auction.
  6. Upload required documents
    • - Ecommerce service registration form (see TMDT-1, 47/2014/TT-BCT)
    • - Ecommerce service provision plans (see 52/2013/ND-CP)
    • - Terms and conditions for purchase, sale, payment methods and privacy (see 52/2013/ND-CP)
    • - An authenticated copy of Investment Registration Certificate (IRC), Enterprise Registration Certificate (ERC), or business license.
Notification process for website
  1. Create an account at "online.gov.vn."
    * You can proceed with further steps after receiving the signup confirmation email from the Ministry of Industry and Trade (MoIT).
  2. Enter name of the business, tax code, address, website name, website address, and other required details in the website notification form.
  3. Select a product or service to sell.
  4. Upload required documents (IRC, ETC, business license, etc.)
2) E-commerce mobile app
Registration process for mobile app
  1. Create an account at "online.gov.vn."
    * You can proceed with further steps after receiving the signup confirmation email from the Ministry of Industry and Trade (MoIT).
  2. Enter name of the business, tax code, address, website name, website address, and other required details in the mobile app registration form.
  3. Add the app name, download link, and icon that will be used in Apple Store, Google Play, and other app stores.
  4. Select your ecommerce business type: online marketplace, online classified, or online auction
  5. Select related services, such as online payment and online auction.
  6. Select a product or service to sell.
  7. Enter the information of your web hosting service provider.
  8. Upload required documents (IRC, ETC, business license, ecommerce registration form, etc.)
Notification process for mobile app
  1. Create an account at "online.gov.vn."

02Things to consider when writing product descriptions

Product descriptions affect consumers' buying decisions. When describing your products, avoid being vague and using misleading statements.
Also, make sure to write product descriptions in compliance with required laws.

Superlatives

Descriptions with superlatives should be accompanied by supporting evidence.
Examples of superlatives include: the best, the smallest, the world's first, and number one.

Comparatives

You should provide specific proof when you claim your product is better than competitors'.
It is recommended that you cite numbers or percentages that justify using comparatives.

Product effectiveness

You need to be extra careful when you describe weight loss, beauty, or food products.
Claims that your product has direct effects on the body, such as "anti-aging" and "brightening," cannot be used under medical law.
Nor can you use claims that your product treats or prevents diseases.

Exaggeration

Making exaggerated and misleading statements is restricted by law. One example is "Sip yourself slim."

Strike-through pricing

It is not allowed to use strike-through pricing, an advertising method crossing out the price previously demanded and displaying a discounted price, to mislead customers.
You can use a strike-through price only when you compare the prices of the same product or provide justifications for the price comparison.

Non-standard grammar and spelling

Google Ads and Yahoo Ads reject contents with intentional misspelling or spacing.
However, you can still use abbreviated words and acronyms if they are commonly used.

Punctuation marks

Using punctuation marks helps to effectively communicate your products to customers, but repeated punctuation is not allowed in Google Ads and Yahoo Ads.

03Applying for your import/export license and declaration

04Personal data protection and copyright law on the internet

Personal data refer to information, such as name and date of birth, that relates to identified or identifiable natural persons.
Any business that handles personal data must state the purposes of data collection and is not allowed to process data without the consent of data subjects.
When you deal with personal data, you must provide a statement of consent on your store and your store must have security measures to protect customers' personal data.

Copyright is the exclusive right given to the creator of a creative work, and an object or an idea known to everyone is not protected by the copyright law.
For example, Mt. Fuji itself is not copyrighted, but the pictures of the mountain are copyrighted works as they have been taken at different times of the day from different angles with different techniques.
Using competitors' photos or descriptions infringes on their copyrights as the photos and descriptions are also protected as creative works.
If you want to use someone else's work without copyright infringement, citation can be an option.
To cite someone else's copyrighted work, you need to follow two rules:

  • Most of your work must be your own creation and the cited work be used only for complementary purposes.
  • The cited work must be distinguished from your work with special characters, such as parentheses.
